Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Nabinagar P.S. Case No. 128 of 2022, G.R. No. 381 of 2022 lodged under Section 30(a) of Bihar Excise & Prohibition (Amendment) Act, 2018.
As per prosecution case, the recovery of 09 liter of country made liquor has been made from the possession of the petitioner.
Learned counsel for the petitioner submits that the petitioner has not been apprehended from the place of occurrence. He further submits that the house from where
Patna High Court CR. MISC. No.50533 of 2022(2) dt.28-11-2022 2/2 recovery has been made is the joint possession of all the family members, there are 3 criminal antecedents against the petitioner and in all cases, he is on bail. He further submits that petitioner is in custody since 16.07.2022 and charge sheet has already been filed in this case.
Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise-Ist, Aurangabad in connection with Nabinagar P.S. Case No. 128 of 2022, G.R. No. 381 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C..
With this observation, the bail application stands allowed.
