The petitioner is in custody since 23.04.2018 in connection with Bihta P.S. Case No. 13 of 2018 for the offence registered under Sections 363, 366/34 of the Indian Penal Code. Learned counsel for the petitioner submits that save and except the allegation that the petitioner had helped the accused Amit Kumar @ Aditya Raj Kasera in taking the wife of the informant when she had gone with her minor child to perform Puja, there is no further material to connect the petitioner with the alleged occurrence. It also appears from her statement made under Section 164 Cr.P.C. that she had willingly accompanied the said Amit Kumar and had gone to Mumbai by flight, and therefore,

the question of abduction could not be arise as she is an adult and a married lady. It has also come on record that the occurrence came to take place on account of Facebook friendship between the wife of the informant and the said Amit Kumar @ Aditya Raj Kasera and the present petitioner has no concern with the said friendship.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate -1st, Danapur in connection with Bihta P.S. Case No. 13 of 2018.
