The petitioner apprehends his arrest in a case registered under Sections 468, 420, 34 of the Indian Penal Code. Allegedly, the petitioner in collusion and conspiracy with the other accused, created false and fabricated document of the land of the informant and sold the same without having any right and title over the land, in question.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been falsely implicated in the present case. The matter relates to civil dispute. The land in question, belongs to the petitioner. The petitioner has been made

Patna High Court CR. MISC. No.48150 of 2019(5) dt.18-12-2019 2/2 accused in the present case due to mistake of fact. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, the petitioner, above named, in the event of his arrest or surrender in the court below within six weeks shall be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Nawada P.S. Case No. 83 of 2018.
