ANJANA MISHRA ORAL ORDER 05-07-2018 Heard the learned counsel for the petitioner and counsel appearing on behalf of the State.
The petitioner is in custody since 09.01.2018 in connection with Surajgarha P.S. Case No.40 of 2014, registered under Sections 323, 341, 504, 324, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
The learned counsel for the petitioner submits that though the petitioner is named in the FIR and is alleged to have fired from his gun. The injury which have been found are not of any fire but to have been caused by hard blunt substance. It is further submitted that the petitioner has been in custody for six months and he undertakes to abide by any terms and conditions as laid down by this Court.
In view of the aforementioned facts and circumstances and
Patna High Court Cr.Misc. No.33194 of 2018 (3) dt.05-07-2018 2/2 the nature of injury found, let the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Lakhisarai, in connection with Surajgarha P.S. Case No.40 of 2014, on the condition that one of the bail will be his father. (Anjana Mishra, J) Sanjeev/- U T
