Mr. Satyendra Prasad ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 21-06-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Kankarbagh P.S.Case No. 76 of 2018 registered under Section 394 of the Indian penal Code.

Allegation in brief is that some unknown miscreants committed road robbery and looted Rs. 2 lacs from the informant and on protest, one the miscreants assaulted on his from the pistol and escaped away with money and his document kept in the bag.

Submission is that prior to arrest of the petitioner, four other co-accused were apprehended by the police but none of them disclosed the name of the petitioner; moreover, so far as recovery of SBI cheque book and Debit card of ICICI Bank of the informant, from the possession of the petitioner, is concerned, that were submitted to him by one Lalan Rajak, as

Patna High Court Cr.Misc. No.35149 of 2018(2) dt.21-06-2018 2/2 petitioner runs a Kiosek Banking system.

It appears that looted documents of the informant including cheque book of the SBI and debit card were recovered from the possession of the petitioner and reason given for possession of the same is unreasonable. So considering the aforesaid facts and circumstances, the prayer of bail of the petitioner is rejected.
