2. The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

3. As per the prosecution case, 87 litres of illicit liquor has been recovered from the bag which was held by Jishan Ahmad.

4. Petitioner is neither cleaner nor driver of the vehicle. No incriminating article has been recovered from his conscious possession. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

6. Considering the aforesaid facts and circumstances,

Patna High Court CR. MISC. No.51137 of 2023(3) dt.28-08-2023 2/2 in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise Court No.I, Siwan, in connection with Mairwa P.S. Case No. 108 of 2019, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
