JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 05-08-2015 The present application has been filed for modification of order dated 05.09.2014 passed in Criminal Revision No. 348 of 2014 to the extent that on the date of order petitioner no. 5 Tanik Sao S/o Ramdhani Sao was dead. Hence, his name may be deleted. Death certificate has been brought on record to the effect that Tanik Sao S/o Ramdhani Sao has died on 17.01.2014. The prayer has also been made that petitioner no. 3 Naresh Sao, who is a government employee, hence payment of compensatory amount will prejudice his service career, hence, he may be exempted from making payment.

Patna High Court Cr.Misc. No.44152 of 2014 (02) dt.05-08-2015 2/2 The order dated 05.09.2014 is modified only to the extent that the name of petitioner no. 5 Tanik Sao S/o Ramdhani Sao is permitted to be deleted since he was dead on the date of order.

This Court is not inclined to consider the other prayer of the petitioner. Accordingly, this modification application is disposed of.

Let the order be transmitted to the court of learned Judicial Magistrate, Ist Class, Nawada in connection with G.R. No. 434 of 2004, Trial No. 1071 of 2013 arising out of Pakaribarawan P.S. Case No. 37 of 2004.
