2. The petitioners have prayed for regular bail in a case registered for the offence punishable under Sections 126(2), 11592), 109, 303(2), 352, 351(2) and 3(5) of the BNS.
3. The case of the prosecution in short is that the petitioners along with 5-6 persons started abusing the informant. It is alleged that on 11.04.2025 the accused persons came in the courtyard of the informant. One Jugesh ordered and all the accused persons started assaulting with lathi & danda. It is specifically alleged that these petitioners assaulted with iron rod on the head of the informant and other body parts. After that they assaulted Chetu Munda.
4. Learned counsel for the petitioners has submitted that
Patna High Court CR. MISC. No.50123 of 2025(3) dt.16-10-2025 2/2 the petitioners are quite innocent and have falsely been implicated in this case. Learned counsel has further submitted that there is allegation against both the petitioners of assaulting with iron rod tow two persons. It is not clear as to which of the petitioner has assaulted which victim. The petitioners and victims are next door neighbours. The occurrence took place on a trivial issue. There was no intention to commit murder. Learned counsel for the petitioners has submitted that the petitioners are men of clean antecedent and are in judicial custody since 14.04.2025 (Fekwa Munda) and 23.04.2025 (Niren Munda).
5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioners.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Balrampur P.S. Case No. 80 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) each of them with two sureties of the like amount each to the satisfaction of learned C.J.M., Katihar.
