The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307 of the Indian Penal Code and 27 of the Arms Act.

It is alleged that co-accused Jitendra Soni fired from rifle on the informant but the pellet hit on the son-in-law of the informant. The wife of the informant came to rescue then co-accused Ram Babu Prasad causing injury on her right hand wrist with lathi and iron rod.

It is submitted by the learned counsel for the petitioner that the injury on the head has been found to be superficial skin deep caused by hard blunt substance.

Patna High Court Cr.Misc. No.9606 of 2015 (2) dt.11-03-2015 Petitioner has caused injury by sharp cutting weapon and the other injury is abrasion on the wrist. No injury by sharp cutting weapon has been received by the informant. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Chapra in connection with Marhowrah P.S. Case No. 378 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
