The petitioner is in custody in connection with Kotwa P.S. Case No. 247 of 2017 for the offence under Sections 272, 273 of the Indian Penal Code and Sections 30(a) and 35(b) of the Bihar Excise Act, 2016.
Learned counsel for the petitioner submits that the name of the petitioner has been surfaced on the confessional statement of co-accused. He submits that the petitioner has no criminal antecedent. He submits that the other co-accused, namely, Krishna Singh has been granted bail by vide order dated 17.02.2018 in Cr. Misc. No. 8649 of 2018, Pannalal Sah has been granted bail vide order dated 23.02.2018 in Cr. Misc. No. 10590 of 2018, Satyendra Thakur has been granted anticipatory bail vide
Patna High Court Cr.Misc. No.36377 of 2018 (2) dt.28-06-2018 2/2 Cr. Misc. 20053 of 2018, Amit Mishra has been granted bail vide order dated 10.05.2018, as per the stamp report. Considering the aforesaid, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Motihari, East Champaran in connection with Kotwa P.S. Case No. 247 of 2017.
