Petitioner's grievance today is that even though he has marked attendance in the inquiry on 24-07-2021, till date, he has not been paid subsistence allowance, so as to enable his participation in the proceedings.

Charge Memo is dated 02-07-2018 (Annexure- 3). The first claimed attendance of the petitioner in the proceedings

Patna High Court CWJC No.18091 of 2021(2) dt.29-08-2023 2/2 is three years thereafter i.e., on 24-07-2021 (Annexure- 8 series). Whether the petitioner has actually marked his attendance or not is not apparent from the documents annexed in support of the statement, as neither does it bear any receiving, nor is there anything to show that it has been submitted. 4.

Let the petitioner appear before the Inquiring Officer-cum-Deputy Collector, Land Reforms, Banka (respondent No. 8) along with copy of this order within four weeks, so as to enable consideration of his claim for payment of subsistence allowance in accordance with law. 5.

Writ application is accordingly disposed of.

It is needless to say that the petitioner is under a legal obligation to extend full cooperation in the proceedings being conducted against him.
