JUSTICE ASHUTOSH KUMAR ORAL ORDER 25-09-2019 The petitioner seeks bail in connection with Barh P.S. Case No. 178 of 2019, dated 06.04.2019, instituted for the offences under Sections 363, 365 and 371/34 of the Indian Penal Code.

It is a peculiar case where a father is alleged to have sold off his newly born son and the report regarding the same has been lodged by none else than the mother of the infant (wife of the petitioner). The infant ultimately died. The materials collected during the course of investigation indicate that the new born baby was sold to one Kanchan Devi, wife of Shashi Sharma, a neighbour, for a consideration of amount of Rs. 50,000/-, but only 15,000/-

Patna High Court CR. MISC. No.47998 of 2019(3) dt.25-09-2019 2/2 rupees was paid to the petitioner. The infant was thereafter handed to another person, but the life of the infant could not be saved.

The petitioner has a different narrative. He submits that right after the birth of the infant, he was diagnosed of jaundice and he had taken the child for treatment where he died.

This explanation is absolutely not believable in as much as an infant would not be taken by the father to a Doctor without being accompanied by the mother of the infant.

In any view of matter, considering the nature of accusation against the petitioner, I am not inclined to grant bail to him.

The petition is dismissed.
