The petitioner is apprehending her arrest in connection with Rajgir P.S. Case No.206 of 2014 registered for the offences under Section 302/34 of the Indian Penal Code. It is submitted on behalf of the petitioner that the deceased had differences with her husband, who resides in Delhi. The petitioner and the deceased are separate from each other since 1997, but they reside in the vicinity of each other. It is further submitted on behalf of the petitioner that she has been falsely implicated in the case. Such submission cannot be appreciated at this stage.

From perusal of the post-mortem report of the

Patna High Court Cr.Misc. No.13057 of 2015 (3) dt.11-06-2015 deceased, it is evident that she was subjected to assault as during the postmortem, it was found that her hyoid bone has been fractured and there is haemorrhage in the surrounding tissues. The prayer for anticipatory bail of the petitioner is, accordingly, rejected.

Let the petitioner surrender in the court below and apply for regular bail which should be considered in accordance with law without being prejudiced by this order. (V.N. Sinha, J) V.P.Sinha/- U
