JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-03-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,307 and 504/34 of the Indian Penal Code.

The prosecution case is that the petitioner Tuntun Singh and co accused Ashwani Kumar abused the informant as he was constructing toilet on his land. It is further alleged that co accused Ashwani Kumar assaulted with lathi to the uncle of the informant when the petitioner also made attempt to make assault but it did not cause any injury to the informant.

It is submitted by the learned counsel for the petitioner that in the background of land dispute the accusation has been levelled and admittedly as per FIR the injury was caused only by

Patna High Court Cr.Misc. No.10589 of 2016 (2) dt.09-03-2016 2/2 co accused Ashwani Kumar.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Begusarai in connection with Teghra P.S. Case No. 9 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C.
