Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 323, 324, 341, 354(B), 380, 448, 504, 506, 34 of the I.P.C. Accusation is of assaulting the informant and his wife and making the wife of the informant necked. It is alleged against accused petitioner No. 3 Ram Sagar Rai that he caused tooth bite injury to the victim Rahul. It is submitted by learned counsel for the petitioners that petitioners are agnates of the informant and in the background of petty dispute the accusation has been levelled when there is counter version of the occurrence also
Patna High Court Cr.Misc. No.9224 of 2015 (2) dt.10-03-2015 2/2 and except one injury of Rahul on the chest which was found to be lacerated, grievous in nature, injuries of other persons have been found to be simple. The petitioners' side have also received injuries.
Considering the nature of accusation, let the petitioners, above named, except petitioner No. 3 namely Ram Sagar Rai, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sheohar in connection with Tariyani P.S. Case No. 192 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
Let learned Court below consider the prayer for bail of petitioner No. 3 namely Ram Sagar Rai, if the petitioner No. 3 surrenders within a period of six weeks and pray for regular bail in connection with Tariyani P.S. Case No. 192 of 2014, pending in the Court of learned Additional Chief Judicial Magistrate, Sheohar.
Accordingly the application with regard to petitioner No. 3 stands disposed off.
