JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-03-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,323,324,307,379 and 504 of the Indian Penal Code. The prosecution case is that in the background of land dispute the FIR named accused persons came variously armed and on the order of petitioner, co accused Abdul Suhan abused the informant and attempted to cause injury with spear on the abdomen but it caused injury on the back when the sister of the informant came to rescue she was also assaulted. It is further alleged that co accused Kamura assaulted with bamboo stick on the head of Sairun Nisha.
It is submitted by the learned counsel for the petitioner
Patna High Court Cr.Misc. No.10593 of 2016 (2) dt.09-03-2016 2/2 that in the background of land dispute the accusation has been levelled. The injury on the informant side has been found to be simple in nature. There is counter version of the occurrence and co accused have been granted anticipatory bail vide Cr. Misc. No. 92 of 2016 and 18587 of 2015. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.J. VI cum ACJM, Purnea in connection with Amour P.S. Case No. 16 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
