Petitioner, already in custody, seeks bail in connection with Buxar (Town) P.S. Case No.128 of 2018 registered under Sections 304(B)/34 of the Indian Penal Code.
Allegation in brief is that marriage of the daughter of the informant and the petitioner was performed in the year 2013 and the daughter of the informant was being tortured by the inlaws and other family members and ultimately killed for nonfulfillment of dowry. Learned counsel for the petitioner submits that marriage was performed in the year 2013 and in fact the
Patna High Court Cr.Misc. No.34528 of 2018(2) dt.29-06-2018 2/2 deceased died of illness as she was suffering from tuberculosis and she was under treatment for a longer period, medical prescriptions have been annexed with the bail application and no injury on her person was found in the postmortem report; whereas the learned counsel appearing on behalf of the informant opposes the prayer of bail.
Having considered the aforesaid facts and circumstances, petitioner Javed Akhtar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Buxar in connection with Buxar (Town) P.S. Case No.128 of 2018.
