Petitioner is in custody in connection with Forbesganj (Simraha) P.S. Case No. 343 of 2018 for the offence under section 30(2) and 38(1) of the Bihar Excise Act. Learned counsel for the petitioner submits that petitioner has no criminal antecedent. He is in custody since 14.5.2018. Learned counsel submits that nothing was recovered from the conscious possession of the petitioner. In fact, seizure was made from the possession of co-accused Rajesh Kumar. Learned counsel submits that the recovered article was cough syrup.
Considering the fact that nothing was recovered from
Patna High Court Cr.Misc. No.36605 of 2018(2) dt.28-06-2018 2/2 the possession of the petitioner and petitioner has no criminal antecedent and remained in custody for more than one and half months, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge, Araria, in connection with Forbesganj (Simraha) P.S.
