The petitioner is in custody in connection with G.R.P.S. Jhajha Case No. 61/2018 for the offence under sections 30(a) & 38(1) of the Bihar Prohibition & Excise Act, 2016. Learned Counsel for the petitioner submits that petitioner has no criminal antecedent. He was arrested in connection with seizure of 25 liters of liquor but in fact nothing was recovered from the conscious possession of the petitioner. Counsel for the petitioner has drawn attention of this Court to the statement made in para-8 that the petitioner is in custody since 30.04.2018 but it has been wrongly mentioned in the impugned order that the petitioner is in custody since 30.05.2018.
