JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-06-2018 Heard learned counsel for the petitioners and State. The petitioners are in custody in connection with Warisnagar P.S. Case No. 95 of 2018 for the offence under Section 273 of the Indian Penal Code and Sections 30(a), 38 and 41 of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioners submits that the petitioners have no criminal antecedent. He further submits that the petitioners have been arrested in this case only on suspicion. It is alleged that these petitioners were loading the cartoon carrying liquor in the Maruti Car, bearing registration no.BR 1M-5100. Learned counsel submits that in the totality of the fact that the petitioners are neither the owner of the vehicle nor the owner of the liquor and they have no criminal antecedent, they deserve bail.
