1. Heard learned counsel for the petitioner, learned Central Government Counsel for the Union of India and learned APP for the State.

2. The petitioner seeks bail in Mahindwara P. S. Case No.119 of 2021 registered for the offences punishable under Sections 8/17(C)/18(C) of the N.D.P.S. Act.

3. The petitioner had earlier moved this Court seeking regular bail vide Cr. Misc. No.62440 of 2021 and the same was rejected by order dated 24.03.2022. It is next submitted that out of six prosecution witnesses, three prosecution witnesses have been examined, out of which, two have been declared hospital, as such, the petitioner has preferred the present bail application

4. The learned counsel for the Union of India opposes the bail application of the petitioner and submits that since the trial has commenced, it would not be prudent to release the petitioner at this stage, when the case is registered under the N.D.P.S. Act.

5. Considering the submission of the learned counsel appearing for the Union of India, the Court is not inclined to release the petitioner on bail.

6. Accordingly, the prayer for bail of the petitioner stands rejected.
