The petitioner apprehends his arrest in a case under Sections 401, 414,420, 406, 379, 411 and 120(B) of the Indian Penal Code and Section 47(A) of the Excise Act. The police intercepted a tanker loaded with spirit and arrested three persons, namely, Shankar Mahto, Sheo Pujan Rai and Sunil Kumar, who are driver and cleaner of the tanker. Shankar Mahto disclosed that Nagendra Rai @ Nago is the owner of the tanker and deals in the illegal business of spirit. Shankar Mahto also disclosed that the petitioner used to convert spirit into wine.

Save and except the confessional statement of the driver and cleaner of the tanker, no further material is collected in the entire case diary.

No.13540 of 2016 (4) dt.27-06-2016 2/2 Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali in Baligaon P.S. Case No. 59/15, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
