JUSTICE ARUN KUMAR ORAL ORDER 25-06-2018 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Petitioner, already in custody, seeks bail in connection with Chhapra Muffasil P.S.Case No. 57 of 2018, registered under Sections 224, 353, 307/34 of the Indian Penal Code and Section 25 (1-b) (i), 26, 35 and 27 of the Arms Act.

The allegation in brief is that the petitioner succeeded in rescuing the apprehended co-accused namely, Kali Singh along with Raju Singh from the police custody after making indiscriminate firing upon police.

Submission of the learned counsel for the petitioner is that there is no allegation of making any firing against the petitioner and the allegation of recovery of pistol and live

Patna High Court Cr.Misc. No.33738 of 2018 (2) dt.25-06-2018 2/2 cartridges from that place, is false because except the police no one was present at the place of occurrence and petitioner has been falsely implicated in this case and is in custody since 31.03.2018. Having considered the said facts and circumstances, the petitioner, Vishal Singh, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Chhapra Muffasil P.S.Case No. 57 of 2018.
