The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 149, 342, 354, 323, 324, 307, 379, 506 of the Indian Penal Code.

Learned counsel for the petitioners seeks permission to withdraw the petition with regard to petitioner No. 1 namely Nagendra Rai since he has been arrested.

Permission is accorded.

Patna High Court CR. MISC. No.61909 of 2021(2) dt.05-07-2022 2/3 Accordingly, the petition with respect to petitioner No. 1 is dismissed as withdrawn.

The accusation is of making assault to the informant and other family members of the informant. The specific accusation of making assault with garasa on the head of the sister-in-law of the informant is against petitioner No. 1 Nagendra Rai. It is alleged against petitioner No. 2 that he assaulted with lathi to the brother of the informant.

It is submitted by learned counsel for the petitioner No. 2 that petitioner and the informant are agnates and in the background of some land dispute, this false case has been lodged against the petitioner. The petitioner's side has earlier lodged Marhowrah P.S. Case No. 49 of 2021 against the informant's side. In the facts and circumstance of the case, let the petitioner No. 2, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on
