JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 01-04-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case under Sections 307/188 and other allied Sections of the Indian Penal Code and Section 27 of the Arms Act.
Allegation is that a number of persons including the petitioner and 22 other F.I.R. named accused persons obstructed the police official / police party from taking away the dead body of a boy. The accused persons indulged in brick bat and pelting of stones, which damaged the public property and also injured some of the police personnel.
Learned counsel submits that the allegation is general in nature and some of the accused persons, including Jitendra Rajak and Shatrughan Prasad @ Shatrughna Prasad, have been
Patna High Court Cr.Misc. No.11554 of 2016 (2) dt.01-04-2016 2 / 2 allowed anticipatory bail by this Court vide order dated 14.01.2016 passed in Cr. Misc. No. 57384 of 2015 and order dated 07.01.2016 passed in Cr. Misc. No. 412 of 2016. Having regard to the facts of the case, in the event of arrest or surrender before the court below within four weeks from today the above named petitioner be released on bail on furnishing bail bond of Rs.5000/- (Five thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st Class, Gaya in connection with Guraru P.S. Case no. 78 of 2015 subject to the conditions as laid down under Section 438 (2) Cr.P.C. with further condition that the petitioner will not physically absent for two consecutive dates till three witnesses are examined in trial, failing which his bail bond would be cancelled.
