Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with Khaira P.S. Case No. 309 of 2021, registered for offence punishable under sections 353, 188, 504, 506, 379, 411, 147 and 149 of the Indian Penal Code and 11/43 of Mining Rules. As per allegation, a tractor loaded with illegally mined sand was seized. 15-20 persons, including men and women,

Patna High Court CR. MISC. No.61720 of 2021(3) dt.20-09-2022 2/2 surrounded the tractor and protested against the police party. The learned counsel for the petitioners has submitted that petitioner nos. 2 and 3 are ladies. All the petitioners are the persons of clean antecedents and their name has figured in the statement of Chowkidar. They are not concerned with the sand nor with the tractor and trolley.

Considering the above-mentioned facts and circumstances as well as the clean antecedents of the petitioners, let them, in the event of their arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Khaira P.S. Case No. 309 of 2021, subject to condition as laid down under section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioners within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
