JUSTICE RAKESH KUMAR) 24-10-2019 At the very outset, Sri Vikash Kumar, learned Standing Counsel No. 11 submits that only yesterday at 3.30 P.M. he had a telephonic discussion with Station House Officer, Katihar Muffasil Police Station and he has been instructed that vehicle of the petitioner i.e. HERO SPLENDOR ISMART Motorcycle bearing Registration No. BR-39T-1850, Engine No. HA12EMGHC21916, Chasis No. MBLHA12ACGHC18787 which has been seized in connection with Katihar Muffasil P.S. Case No. 139 of 2019 registered for the offence under Section 37(C) of the Bihar Prohibition And Excise Act, 2016, has

Sri Sanjeev Kumar Singh, learned counsel for the petitioner was not aware about this development. However, since with full sense of responsibility a statement has been made by Sri Vikash Kumar, learned Standing Counsel No. 11 regarding release of the vehicle, there is no reason not to accept the same, and as such, we are of opinion that in view of release of the petitioner's vehicle, the writ petition has become infructuous.

Accordingly, the writ petition stands disposed of as same has become infructuous.
