Petitioner is in custody in connection with Excise P.S. Case No. 136 of 2018 for offence under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent and petitioner is in custody since 10.04.2018. He further submits that nothing was recovered from the physical possession of the petitioner not from the house of the petitioner and the liquor was seized from the motorcycle which was not the motorcycle of the petitioner but of different person.

Considering the aforesaid, let the petitioner, above

Patna High Court Cr.Misc. No.33794 of 2018(2) dt.06-06-2018 2/2 named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, at Gaya, in connection with Excise Case No. 136 of 2018.
