2. Petitioner apprehends arrest in a case registered for the offences punishable under Section 414 of the Indian Penal Code and Sections 30(a), 32(2), 41(C) of the Bihar Prohibition and Excise Act.
3. As per prosecution case, 406.080 litres illicit liquor has been recovered from a Bolero pick-up and a motorcycle.
4. Learned counsel for the petitioner submits that no incriminating material has been recovered from the conscious possession of the petitioner. Petitioner is neither driver nor owner of the vehicles in question and he has been made accused only on the basis of confessional statement of co-accused Sudhir Kumar. Petitioner claims clean antecedent.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Excise Court No. 2-cum-Additional District & Sessions Judge, Vaishali at Hajipur in connection with Vaishali (Belsar O.P) P. S. Case No. 44 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
