JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 3 02-09-2015 Heard Mr. Yogesh Chandra Verma, learned senior counsel for the petitioners. None appears on behalf of the State. The petitioners seek pre-arrest bail in connection with Fatehpur P.S. Case No. 391 of 2014 registered under Sections 302 read with 34 and 201 of the Indian Penal Code as also Section 3(2)(v) of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act.
It would appear from perusal of the FIR that two persons were killed by some unknown criminal. The informant happens to be the daughter-in-law of the two deceased. In the FIR, she has raised suspicion against the petitioners and one
Patna High Court Cr.Misc. No.12871 of 2015 (3) dt.02-09-2015 2 / 2 another, who were on inimical term with the deceased. It would further appear from the impugned order that in course of investigation, witnesses have stated about involvement of the petitioners in the alleged offence.
Regard being had to the serious nature of crime and the materials collected during investigation against the petitioners, I am not inclined to grant him anticipatory bail. Accordingly, their prayer for anticipatory bail is rejected. (Ashwani Kumar Singh, J.) Sanjeet/- U T
