2. The petitioner is in custody in a case registered for the offence punishable under Section 414 of the Indian Penal Code.

3. As per allegation in the FIR, it is a case of recovery of 94 stolen mobiles from the possession of the petitioner.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that merely on the basis of suspicion, police recovered unclaimed bag beneath the seat of the petitioner and presumed that said article belong to this petitioner and petitioner has no concern with the recovered mobile set and seizure list was made

Patna High Court CR. MISC. No.56134 of 2024(2) dt.19-08-2024 2/2 without compliance of Section 100 of the Cr.P.C. Petitioner has got clean antecedent as stated in para-3 of the petition and he is in custody since 24.04.2024.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

6. In the aforesaid facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Kiul (Lakhisarai) in connection with Rail Jamalpur P.S. Case No. 30 of 2024.
