By filing this application, the petitioner has renewed his prayer for regular bail in connection with Naubatpur P.S. Case No. 156 of 2014 registered for the offences punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act. He has seven criminal antecedents. Earlier, his prayer for bail was rejected by this Court vide order dated 21.09.2021 passed in Cr. Misc. No. 25431 of 2021.
Ms. Nivedita Nirvikar, learned Senior Counsel representing the petitioner does not dispute the statement of Mr. Sudama Singh, learned Advocate for the informant that the trial
Patna High Court CR. MISC. No.51046 of 2022(3) dt.21-06-2023 2/2 is on the verge of conclusion as only two witnesses, namely, the Doctor and the Investigating Officer remain to be examined. Mr. Madan Kumar, learned APP for the State is present and has opposed the prayer for bail of the petitioner. Considering the reasons already provided in the earlier order of rejection and the fact that now the trial is on the verge of conclusion, this Court is not inclined to release the petitioner on bail.
The learned trial court is directed to conclude the trial as early as possible by keeping the records on shorter dates. The prosecution must co-operate by producing the Doctor and the Investigating Officer of the case on the dates fixed in the matter. The Superintendent of Police, Patna shall ensure that the prosecution witnesses are duly produced on the date fixed in the matter.
