2. Heard learned counsel for the petitioner and learned A.P.P. for the State.
3. The petitioner apprehends arrest in connection with Sherghati P.S. Case No. 614 of 2021 instituted under Sections 341, 323, 307, 387, 420, 467, 468, 471, 120(B)/34 of the Indian Penal Code and 27 of Arms Act.
4. As per the prosecution case, the petitioner alongwith other accused persons sold the land of the wife of the informant by making false sale deed as also assaulted the informant and snatched Rs. 25,000/-.
5. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.57614 of 2024(3) dt.29-11-2024 2/2 petitioner is innocent and has committed no offence. The petitioner has no concern with the alleged occurrence.
6. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
7. From the reading of the pleadings, it appears to be primarily a land dispute.
8. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 1st Sherghati, Gaya in Sherghati P.S. Case No. 614 of 2021, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
