This is an appeal under Section 14(A)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter in short referred to as the SC/ST Act) against the refusal of prayer of bail vide order dated 27.06.2025 passed by the Court of learned District and Additional Sessions Judge 1st cum-Special Judge (SC/ST), Bettiah, West Champaran in connection with B.P. No. 2259 of 2025 arising out of Balthar P.S. Case No. 55 of 2025 Dated 02.05.2025 registered for the offence/s punishable u/ss 126(2), 115(2), 118(1), 303(2), 352, 351(2) read with 3(5) of B.N.S and
Patna High Court CR. APP (SJ) No.2981 of 2025(4) dt.25-09-2025 2/3 Sections 3(1)(r) 3(1)(s) 3(2) (va) of SC/ST (POA) Act.

As per the prosecution case, the informant alleged that the appellant along with six other co-accused persons namely, Raj Kumar Das, Kishun Das due to which the informant sustained severe injury in his back and Budha Das sustained head injury. Kundan Das, Chandan Das, Rohit Patel and Satyendra Patel have brutally assaulted the informant and his friend Budha Das with intention to kill them and also humiliated the informant by abusing him by caste name.
4. Learned counsel for the appellant has submitted that the appellant has falsely been implicated in this case due to ulterior motive. There is an unexplained delay of about eleven days in lodging the present FIR. It is submitted that there is general and omnibus allegation against the present appellant. It is further submitted that the informant and his friend have sustained simple injuries during the course of alleged occurrence. The appellant has no criminal antecedent as stated at para 3 of the bail petition. The appellant is in custody in this case since 20.06.2025.
5. Learned Spl.P.P. for the State as well as learned counsel for the informant have vehemently opposed the prayer of bail.

In view of the aforesaid facts and circumstances of the case as well as finding substance in the contention of the learned counsel for the appellant, the impugned order dated passed by the Court of learned District and Additional Sessions Judge 1st cum-Special Judge (SC/ST), Bettiah, West Champaran in connection with B.P. No. 2259 of 2025 arising out of Balthar P.S. Case No. 55 of 2025 is set aside against the appellant. The criminal appeal is allowed.
7. Accordingly, the above named appellant, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned District and Additional Sessions Judge 1st cum-Special Judge (SC/ST), Bettiah, West Champaran in connection with B.P. No. 2259 of 2025 arising out of Balthar P.S. Case No. 55 of 2025.
