2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 191(2), 191(3), 190, 126(2), 115(2), 117(2), 109(1), 103(1), 76 and 303(2) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, when the informant had gone to the field to attend call of nature, in the meantime, accused persons came there and started teasing her and also tore her clothes. Meantime, other family members came there and protested. Thereafter, all the 33 FIR named accused persons including some unknown accused persons gathered there and assaulted prosecution side causing them injuries. Injured Chandradeep Paswan died during treatment.

4. Learned counsel appearing for the petitioner submits that from bare perusal of the FIR it is clear that specific

No.49576 of 2025(2) dt.06-08-2025 2/2 allegation of assault by lathi, danda and sword to the deceased Chandradeep Bhagat is against co-accused Ranjan Paswan and Bikash Paswan. There is general and omnibus allegation of assault is against this petitioner and no specific overt act has been alleged against her. Petitioner is a lady and as a matter of fact she was not even present on the spot when alleged incident took place. Petitioner claims clean antecedent.

5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Daudnagar, Aurangabad in Haspura Police Station Case No. 77 of 2025, subject to the conditions laid down under section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
