Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 354 of the Indian Penal Code and 8 of the Prevention of Children From The Sexual Offences (POSCO) Act.
It is alleged that the petitioner used to do obscene act and obscene talk with 10 years minor daughter of the informant.
It is submitted by the learned counsel for the petitioner that informant had taken loan of Rs. 1,000,00/- from the petitioner for running his shop, but he did not return the same hence the present case has been lodged maliciously. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
Patna High Court Cr.Misc. No.15680 of 2015 (2) dt.04-05-2015 .The aforesaid facts constitute a ground for consideration of prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Patrakar Nagar P.S. Case No. 239 of 2014, pending in the court of learned Additional Sessions Judge-I, Patna.
With this observation this application is disposed of.
