The petitioners apprehend their arrest in Nanpur P.S.Case No.95 of 2014, registered for the offences punishable under Sections 323 and other Sections of the Indian Penal Code and Section 3(i)(x) of the SC/ST Act.
The informant made allegation that the petitioners and other accused persons entered into his house and assaulted other family members only because on 17.03.2014 the informant tried to pacify the quarrel going on between Bharat Sahani and Anil Shah. Learned counsel for the petitioners submits that there is allegation of assault against the petitioners on account of some petty dispute. The informant lodged the case under Section 3(i)(x)
Patna High Court Cr.Misc. No.7435 of 2015 (2) dt.23-02-2015 of the SC/ST Act and other Sections of the Indian Penal Code, although, no specific allegation has been made that who abused the informant.
Considering the nature of allegations made against the petitioners it appears that on account of some petty dispute, the case is lodged against the petitioners. In the circumstances, petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of CJM, Sitamarhi in Nanpur P.S.Case No.95 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
