JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 17-03-2016 After some argument, the learned counsel appearing on behalf of the petitioner seeks permission to withdraw the present application with a liberty to surrender in the court below and seek regular bail in connection with Kotwali P.S. Case No. 26 of 2011, giving rise to S. Tr. No. 1101 of 2013 along with S.Tr. No. 695 of 2012, pending in the court of learned Addl. Sessions Judge, VII, Civil Court, Patna.

Permission is accorded.

The application stands dismissed as withdrawn with the liberty aforesaid.

It goes without saying that if the petitioner surrenders in the court below within a period of six weeks from today and applies for regular bail, then the same shall be considered and decided on its own merit without being prejudiced by rejection of the prayer for grant of anticipatory bail.
