JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-03-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Section 498A of the Indian Penal Code.

The basic accusation is of torture.

It is submitted by the learned counsel for the petitioner that the petitioner admits his marriage with the complainant but on the date of marriage she was carrying pregnancy of 22 weeks as a result the petitioner filed Divorce Case No. 278 of 2014 which was decreed ex parte and the marriage between the petitioner and

Patna High Court Cr.Misc. No.12216 of 2016 (2) dt.14-03-2016 2/2 O.P. No. 2 Rekha Devi was annulled by the decree of nullity and thereafter the order of cognizance in the present case was passed on 27.4.2015.

Considering the fact that the marriage between the petitioner and O.P. No. 2 was annulled by a decree passed by the learned Principal Judge, Family Court, Saran at Chapra, prior to the order of cognizance, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Saran at Chapra in connection with Complaint Case No. 2603 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
