2. The petitioner apprehends his arrest in Atri P.S. Case No. 236 of 2021 registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code and Sections 30(a)(d) of the Bihar Prohibition and Excise Amendment Act, 2018, pending in the Court of learned Additional Sessions Juge-cum-Excise Spl. Excise Court No. 1, Gaya.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, the instant application is dismissed as withdrawn.

6. However, if the petitioner surrenders before the learned Court below within a period of six weeks from today and seeks regular bail, the learned Court below would pass the order, preferably, on the same day, without being prejudiced by this order.
