The petitioners seek anticipatory bail in a case instituted for the offences under Sections 420, 120(B), 406, 504, 341, 342 and 506/34 of the Indian Penal Code.
It has been alleged that petitioners are dealer of Honda Motorcycle. So far informant is concerned he is also selling the motorcycle in Lakhisarai. As per claim of the informant he has paid Rs.3,00,000/- on 4.6.2011 as security and later on he has also paid Rs.16,00,000/- for giving franchise but the petitioners resiled from the commitment which led to filing of Begusarai Nagar P.S. Case No.389 of 2014 and when the petitioners could know about filing of the criminal case they
Patna High Court Cr.Misc. No.11804 of 2016 (2) dt.16-03-2016 have sorted out the dispute with the informant. Both sides are satisfied on the terms of compromise which is apparently clear from Annexures-2 and 2/1 where it has been stated that they have settled the dispute out side the Court.
Looking to the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today, let petitioners, namely, Vijay Chaudhary alais Vijay Kumar Chaudhari and Balram Chaudhary, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in connection with Begusarai P.S. Case No.281 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal procedure.
