The petitioners seek bail in anticipation of their arrest in connection with Ram Nagar P.S. Case No. 447/2017 dated 24.11.2017 instituted for the offences under Sections 147, 341, 323, 307, 354, 379, 504 and 427 of the Indian Penal Code. An occurrence took place because of earlier existing land dispute between the parties. Though some of the petitioners are alleged to have assaulted the members of the prosecution party but the allegations are general and omnibus in nature. There is a counter version of the occurrence as well and many persons from the side of the petitioners also have been injured.
Patna High Court Cr.Misc. No.33856 of 2018 (2) dt.05-07-2018 2/2 Regard being had to the aforesaid facts and also taking into account that the occurrence arose out of a small dispute related to earlier land dispute, they are directed to be released on bail, in the event of their surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bond in the sum of Rs. 10,000/- (Ten Thousand), with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Bagaha, West Champaran in connection with Ram Nagar P.S. Case No. 447/2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
