The petitioners seek bail in a case instituted for the offences under Sections 302, 34 and 120B of the Indian Penal Code.

The prosecution case in short is that the son of the informant left the house and did not return and later his dead body was found.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 20.5.2019 and have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The dead body of the

Patna High Court CR. MISC. No.47070 of 2019(2) dt.02-08-2019 2/2 deceased is said to have been recovered from the house of Tega Ram. As far as petitioner is concerned, it is a case of last seen. Except for suspicion, there is no other substantive evidence to suggest his implication in the present case. There is no eye witness to the alleged occurrence.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Rohtas at Sasaram in connection with Baghaila P.S. Case No. 13/2019.
