The petitioners apprehend their arrest in a criminal prosecution registered under Sections 384, 386, 387, 120B and some other allied offences under the Indian Penal Code as also under Section 27 of the Arms Act.

The learned counsel appearing on behalf of the petitioners submits that there is contractual disputes between the petitioners, at one side and the informant, on other side, as a result of which present prosecution has been launched. As per prosecution case, the accused persons are alleged to have demanded ransom of Rs.5 lacs.

Taking into consideration the fact that the allegations against the petitioners are very serious in nature and also taking into consideration the fact that the petitioners are accused in other criminal cases, besides the present one, this Court is not inclined to accede to the prayer made on behalf of the petitioners for grant

Patna High Court Cr.Misc. No.11875 of 2016 (2) dt.18-03-2016 2/2 of anticipatory bail. Accordingly, their prayer for anticipatory bail in connection with Pakridayal P.S.Case No. 79 of 2015 pending in the court of the learned Additional Chief Judicial Magistrate V, East Champaran, Motihari is rejected.

However, if the petitioners surrender in the court below within a period of four weeks from today and apply for regular bail, then the same shall be considered on its own merits without being prejudiced by the present order. (Birendra Prasad Verma, J) Tahir/- U T
