This application, for grant of anticipatory bail, arises out of Basopatti Police Station Case No. 53 of 2018, disclosing offences under Sections 147, 149, 341, 323, 379, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act. Learned Counsel for the petitioner has submitted that the petitioner is innocent and has not committed any offence. In fact, the sister of the informant willingly performed marriage with Saroj Kumar Gupta, which is evident from annexure-2 and this petitioner has falsely been implicated in this case. This petitioner has not concern with Saroj Kumar Gupta and the sister of the informant in any manner. Hence, the
Patna High Court Cr.Misc. No.33926 of 2018 (2) dt.07-06-2018 petitioner deserves the privilege of anticipatory bail. Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate-V, Madhubani, in connection with Basopatti Police Station Case No. 53 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
