Petitioner apprehends arrest in a case registered for the offence punishable under Sections 324, 307 and other allied sections of Indian Penal Code.

As per FIR, this petitioner and one co-accused Durgesh Kumar gave dagger blow on the head of the informant. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is next submitted that though there is allegation of assault by this petitioner and one co-accused but the informant sustained only one sharp cut lacerated injury. Moreover, FIR has been lodged after delay of 6 days. Petitioner is a lady and has got clean antecedent.

No.50402 of 2022(2) dt.15-12-2022 2/2 Learned counsel for the informant vehemently opposes the prayer for bail application submitting that allegations in the FIR are duly supported by injury report. Considering the aforesaid facts and circumstances, let the above named petitioner in the event of her arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in Balia P. S. Case No. 352 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
