Mr. Sri Bharat Lal ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 20-07-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Madhepura P.S.Case No. 247 of 2017 registered under Sections 399,402,413 and 414 of the Indian penal Code and under Sections 25(1-b)a,26 and 35 of the Arms Act.
It's a case of making plan for committing dacoity by some miscreants and few of them apprehended by the Police with arms but the petitioner is alleged to have escaped away. Submission is that there is no recovery of any arms from possession of the petitioner and he was not apprehended at the spot and also the persons from whose possession, arms were recovered, namely, Raushan Kumar and Amit Kumar Ram have been admitted bail by co-ordinate Benches of this Court vide Cr.
Patna High Court Cr.Misc. No.36515 of 2018(4) dt.20-07-2018 2/2 Misc. No. 61432 of 2017 and Cr. Misc. No. 63560 of 2017 respectively.
Having considered the aforesaid facts and circumstances, the petitioner, namely , Manish Yadav is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Madhepura in connection with Madhepura P.S. Case No. 247 of 2017.
