04-07-2018 Heard Sri Rajeev Ranjan No. II, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 19-02-2018 in Ahiyapur P.S. Case No. 173 of 2018 registered for offence under Sections 399/402 of the Indian Penal Code and Sections 25(1-B)a/26/35 of the Arms Act, 1959, has prayed for grant of bail.

At the very outset, learned counsel for the petitioner has drawn my attention to statement made in paragraph - 3 of the petition to show that petitioner is having clean antecedent. It was submitted by learned counsel for the petitioner that petitioner has falsely been made accused on an accusation, as if, petitioner with others had assembled for preparation of committing dacoity and recovery of one loaded country-made

Patna High Court Cr.Misc. No.33825 of 2018(3) dt.04-07-2018 2/2 pistol from the petitioner was shown.

Considering the nature of accusation, clean antecedent as well as period of custody, let the petitioner namely Prashant Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. cum Sub Judge - X, Muzaffarpur in connection with Ahiyapur P.S. Case No. 173 of 2018.
