Petitioner seeks bail in Darauli P.S. Case No. 38/2019, instituted for the offence under Section(s) 272, 273, 420 and 120(B) of the Indian Penal Code read with Sections 30(a) and 38(i) of the Bihar Prohibition and Excise Act. It is alleged in the written report that total 3447.720 litres of foreign liquor has been recovered from a Container truck, which was driven by petitioner. Seeing the police party, petitioner started running away leaving the Container Truck but on chase he was apprehended by the police.

Considering the recovery of huge quantity of illicit liquor from the Container Truck, which was driven by petitioner, this Court is not inclined to grant bail to the petitioner

Patna High Court CR. MISC. No.48182 of 2019(2) dt.07-08-2019 2/2 at this stage. Accordingly, prayer for bail of petitioner is rejected.

The trial court is directed to expedite the trial. Petitioner is given liberty to renew prayer for bail after six months of framing of charge.
