The petitioner has been in custody since 28.02.2018 in connection with R.P.F. Patliputra P.S. Case No. 01 of 2018 registered for the offences punishable under Section 3 of R.P. (U.P.) Act.

Learned counsel for the petitioner submits that only on the basis of suspicion, the petitioner has been taken into custody and the recovery, admittedly, has been made from the railway tracks and not from the conscious possession of the petitioner.

Considering the aforementioned facts and circumstances and that the petitioner has got no criminal antecedent, let the petitioner above named, be released on bail on
